The use of https://hiry.me (hereinafter referred to as “Website”) by accessing the Website and/or performing any active actions to use the Website’s functionality implicate and integrate the acceptance of these Terms of use and will be considered within legal rights, proof of knowledge of these on the part of the person using the Website (hereinafter referred to as “User” or “You”). In the event that you do not agree with all of these conditions, you should not use the Website.

These Terms of use are governed by the laws of Germany to the extent permitted. In the event of a dispute that cannot be settled in an amicable way, the District Court of Stuttgart shall be the competent venue for resolving such dispute.
The Website’s aim is to provide the ability to request recruitment assessment services from HIRY, as stipulated on the Website.
You understand and agree that the Website might provide more information, but that any descriptive information regarding HIRY’s services on the Website shall not be considered to contain any legally binding statements and/or obligations on behalf of HIRY.
Access to the Website
The User must make all the necessary equipment and software available in order to connect to the Website, including, amongst other things, the mobile phone or other access devices, as well as stable Internet connection. HIRY can interrupt the functionality of the Website to carry out any repair works, system corrections, maintenance and/or improvements that it considers necessary, without any prior notification of the User, and by agreeing to these Terms of use the User agrees that such interruptions shall not be grounds for any claims, monetary or otherwise.
HIRY may modify or interrupt access to the Website temporarily or permanently.
HIRY does not guarantee Website’s functionality on all equipment and software.
User Responsibility
HIRY will not be held responsible for any losses or damages suffered by the User due to the User not following these Terms of use in any way. User is obliged to not use the Website and any services of HIRY improperly (including but not limited to in violation with its purpose) negligently or maliciously, and to abide by all applicable laws in respective country, respect the rights of HIRY and any third parties, including the rights to brand names, patents, copyright and any other commercial, intellectual or industrial property rights. HIRY reserves the right to hold User responsible in full accordance with the applicable law, as well as the right to request any damages caused by User’s malicious or negligent actions.
Moreover, you recognize and accept that the use of the Website and HIRY’s services is not permitted for the purposes other than explicitly provided for by HIRY or that arise from the Website itself.
You are solely responsible for your conduct, the data provided to us and your communications with us and others. It is your sole responsibility to ensure that you have all rights and permissions needed to comply with this Agreement and to avoid infringement or violation of any rights of others. If you communicate to HIRY that you are acting on behalf of any company and/or other subject, you hereby guarantee that you are fully and legally allowed to perform actions and take responsibility on behalf of such subject. HIRY has no obligation to verify your affiliation and/or connection with such subject, and in the event the subject later claims it never intended to communicate with HIRY and/or request services, you shall be solely responsible for resolving such disputes without HIRY’s involvement.
In the event legal proceedings are initiated against HIRY based on the data and/or false representations you provided to us, as well as due to your breach of your other obligations hereunder, you undertake to compensate all losses and damages to HIRY, including attorney fees, no later than 10 (Ten) days after receiving a request from us by email or otherwise.
You undertake to comply with all laws, including the GDPR and EU privacy laws. You undertake not to take any actions that may lead HIRY to a breach of the current Data Regulations Law.
You acknowledge that HIRY has no obligation to monitor any information that is provided by you and that we are not responsible for the accuracy, completeness, appropriateness, safety or legality of any data, information or content you may receive, except when directly stipulated otherwise in the applicable legislation.
You may not act in a way that affects the stability, availability, functionality of the Website and/or any of our services.
You may not violate the applicable laws in any way, to infringe the intellectual property rights of others.
You shall act in full compliance with our guidelines, if any. You understand that we may need additional information from you, therefore, you shall respond to all our requests no later than two (2) days from the date our request has been sent, by email or otherwise, otherwise we may not explore collaboration opportunities with you.
You shall not publish the fact of our cooperation, including potential cooperation, unless we previously approved such publication in written form.
You may not use the Website and services in a way that would subject us to any industry-specific regulations without obtaining our prior consent in written form.
You are forbidden to act in any way that may result in any negative consequences for HIRY and its affiliates. You shall always act in good faith.
You understand that HIRY may disclose business, technical or financial information relating to its business (hereinafter referred to as «Proprietary Information» of HIRY). Proprietary Information of HIRY includes non-public information regarding features, functionality and performance of the Website, HIRY’s services, corporate structure, as well as that of HIRY and/or its affiliates. You agree: (i) to take all precautions to protect such Proprietary Information, and (ii) not to use or divulge to any third person any such Proprietary Information. HIRY agrees that the foregoing shall not apply with respect to any information after five (5) years following the disclosure thereof or any information that you can document (a) is or becomes generally available to the public, or (b) was in its possession or known by it prior to receipt from HIRY, or (c) was rightfully disclosed to it without restriction by a third party, or (d) was independently developed without use of any Proprietary Information of HIRY or (e) is required to be disclosed by law.
You hereby fully and unconditionally understand and agree that your breach of these Terms may cause irreparable harm to HIRY, and that in the event such breach takes place, you shall provide compensation in the amount HIRY sees fit, including after calculating all damages caused by your breach, and if the calculations are impossible to provide and/or if your breach caused loss of future profit and/or tarnished our brand, you shall pay compensation no later than 5 (Five) business days after receiving the request for compensation, in the amount HIRY requested.
By providing us with your email address, you agree to receive all required notices electronically, to that email address. It is your responsibility to update or change that address, keep other contact information correct and up-to-date, as well as monitor correspondence from HIRY, including in spam folders, as case may be.
Responsibilities and services of HIRY
The Website may provide you with an opportunity to request HIRY’s services, including requesting a demo of such services. HIRY’s services may include providing customizable assessment solutions for recruitment. In the event you require HIRY’s services, you have to fill in a small form on the Website and contact us as provided on the Website. Services’ description shall be provided on the Website and/or communicated to you by HIRY.
The cost of Services is provided on the Website and/or shall be stated in an invoice from HIRY. By paying an invoice you agree with the cost of Services.
HIRY does not guarantee your satisfaction with the Services, as well as does not state that the Services shall fit your needs, increase your profit, help you recruit and/or assess your candidates, as well as does not provide any other representations and warranties, except if explicitly stated in these Terms otherwise. User understands and agrees that information on the Website regarding the Services, their quality and other similar characteristics does not constitute a guarantee that such quality and/or characteristics shall be met and maintained. In the situation where HIRY is unable to provide Services after the payment has been performed, the payment for Services shall be refunded to you using the same payment method/bank details with no sanctions applicable towards HIRY. HIRY does not guarantee the quality, accuracy, reliability, correction or the morality of the data, programs, information, Website or services whatever the origin whether they from its network or from networks that the User can access through HIRY. User accepts that HIRY is exempt from all responsibility related to the Website. The User also assumes sole responsibility for any consequences, damages or actions that can derive from accessing the Website and/or using the Services.
HIRY will not be held responsible by the User for the technical availability nor the contents of the web pages of its third parties links to which can be found on the Website.
HIRY cannot be held responsible for direct or indirect facts, acts or damages that can derive from using third parties as a consequence of using services. This limited guarantee and limited responsibility mentioned in the above paragraphs do not accept the statutory rights of the Users.
Website, HIRY’s services and access to the Website are provided on the “as is” basis, and HIRY shall not bear any responsibility for any discrepancy between the User’s expectations of the Services and the Services as such.
Rights of Intellectual and Industrial Property
